Another bill is pushing banning kids from MC

Bill bans kids on motorbikesSENATE Majority Leader Vicente Sotto III seeks the passage of a law that will prohibit children from riding at the back of motorcycles. He filed Senate Bill 2609 amid concerns on the potential risks of allowing children at the backseat of motorcycles. Sotto’s proposal carries a a fine of P5,000 for first-time offenders, P10,000 for second offense and P20,000 for the third and succeeding offenses. However, SB 2609 will not be applicable in remote places or provinces where there is “no considerable vehicular traffic and such is the only means of transportation.” Sotto said “emergency situations are exemptions, especially if the use of motorcycle is the only available option.” He cited the power of the State to invoke its power of parens patriae, the constitutional mandate to “assume and act as a natural parent or guardian to safeguard the welfare of any child or individual or an incapacitated and dependent minor who is in need of protection against danger, risk of lives and limbs.” “Children riding at the back of motorcycles are considered as reckless endangerment,” he said. Reckless endangerment is the act of doing something with the full knowledge that it potentially endangers the life or safety of someone, he said. Sotto said children are extremely vulnerable and at risk because of their tender age. “Their reflexes are different from adults and they may not be able to react rightly to some situations,” he said. “They may fall and suffer injury or even death. It is, therefore, necessary to enact a law that would prohibit any person from allowing children 12 years old and below to ride at the back of motorcycle if the motorcycle driver is travelling on public and private roads,” he added. MANILA, Philippines - Anim na taong kulong at multang aabot sa P5,000 sa motor rider na mahuhuling nag-aangkas ng isang bata na 13 anyos pababa.

Nakasaad sa panukala ni Manila 2nd District Councilor Rodolfo Lacsamana, na isinalang sa first reading kahapon sa sesyon ng konseho, inilalagay sa bingit ng panganib o kamatayan ang mga bata na angkas sa harap o likod ng motorsiklo, na sa kasalukuyan ay masyado nang talamak habang ‘kaskasero’ pa ang mga namamataang nagmamaneho.

Kumpara umano sa apat ang gulong na behikulo, mas delikado ang dalawang gulong na motorsiklo kaya hindi dapat payagan ang pagsasa­kay dito ng mga bata.

Sakaling pumasa, multang P2,000 sa unang pagkakahuli, P3,000 sa ikalawa at P5,000 kung nakagawa na ng ika-3 offense ang isang motor rider, o makulong ng 6 na buwan.
